They also implement licensing regimes for Virtual Asset Service Providers (VASPs) and establish specific tax treatments, creating a patchwork of rules that demands careful navigation from market participants.

The Evolving Landscape of Crypto Regulation by Country

Governments and financial bodies are increasingly moving towards greater oversight in the cryptocurrency sector. This push stems from a desire to mitigate risks associated with anonymity and rapid market fluctuations. Key international organizations, like the Financial Action Task Force (FATF), play a crucial role in setting global standards.

The FATF defines a Virtual Asset Service Provider (VASP) broadly, encompassing entities involved in exchanging, transferring, safeguarding, or offering financial services related to virtual assets. These definitions underpin many national regulatory frameworks. The FATF Travel Rule, for instance, mandates VASPs to collect and transmit originator and beneficiary information for transactions above certain thresholds, mirroring traditional financial transfer requirements.

A central pillar of virtually all global crypto regulation efforts involves robust Anti-Money Laundering (AML) and Counter-Terrorist Financing (CFT) protocols. These measures aim to prevent illicit funds from being disguised as legitimate income and to cut off financial support for terrorist activities.

Global Regulatory Approaches Comparison

European Union Leads with MiCA Framework

The European Union has positioned itself at the forefront of digital asset legislation with its Markets in Crypto-Assets (MiCA) Regulation. Adopted by the European Parliament in April 2023, MiCA represents the EU’s first truly comprehensive legal framework for crypto assets that previously fell outside conventional financial regulation.

The framework aims to bolster investor confidence, ensure financial stability, and foster innovation across all 27 member states. Understanding the MiCA framework is crucial for any entity operating within the EU.

MiCA broadly defines a crypto-asset as a digital representation of value or rights transferred and stored electronically, typically using distributed ledger technology. Its scope covers the issuance of crypto assets, public offerings, admission to trading, and the authorization and supervision of Crypto-Asset Service Providers (CASPs). The regulation allows a single authorization obtained in one member state to “passport” services throughout the entire EU.

MiCA’s Scope and Implementation Timeline

MiCA categorizes crypto assets into three primary types: Asset-Referenced Tokens (ARTs), Electronic Money Tokens (EMTs), and other crypto-assets. These distinctions help tailor regulatory requirements to the specific nature and risk profile of each digital asset. Issuers must provide transparent information to consumers, while CASPs are required to register, implement stringent security measures, and adhere to AML guidelines.

The implementation of MiCA occurred in phases, beginning with rules for stablecoins, specifically ARTs and EMTs, which came into effect on June 30, 2024. Regulations for CASPs, covering licensing and operational requirements, followed shortly thereafter, applying from December 30, 2024. This staggered approach allowed businesses and regulators time to adapt to the new mandates.

Diverse Approaches in the United States and United Kingdom

The United States operates with a more fragmented approach to crypto regulation by country, where various agencies assert jurisdiction based on the specific characteristics of the crypto asset in question. The Securities and Exchange Commission (SEC) typically oversees assets deemed securities, while the Commodity Futures Trading Commission (CFTC) regulates those classified as commodities.

Meanwhile, the Financial Crimes Enforcement Network (FinCEN) manages AML/CFT compliance for entities involved in money transmission.

The U.S. Securities and Exchange Commission (SEC) has been particularly active in asserting its jurisdiction over crypto assets it deems securities, leading to numerous enforcement actions and policy statements.

Regarding stablecoins, the GENIUS Act, enacted in July 2025, established a federal payment-stablecoin license. This legislation introduced specific reserve and disclosure requirements for both bank and non-bank issuers, aiming to bring greater clarity and stability to this segment of the market.

Taxation of crypto in the U.S. also varies significantly. Short-term capital gains, derived from assets held for less than a year, are taxed as ordinary income, with rates ranging from 10% to 37%. In contrast, long-term gains, from assets held over a year, benefit from lower rates of 0%, 15%, or 20%, depending on the individual
